I was going by the angle of the smoke trail to the aircraft. The other reason it could appear that way of course would be if it was turning away from the aircraft. Given the lack of any fore or aft aspect to the shot it's hard to figure out which it's doing.

It's extremely difficult to estimate altitude when over water without any reference point, whatsoever.
